Insight

Recently, the US Food and Drug Administration (FDA) issued the 2026 Inspection Operations Manual, an 839-page comprehensive document detailing FDA’s procedures, policies and guidance governing inspections and investigations across pharmaceutical, biotech and medical device industries.

Unannounced Pharmaceutical Inspections

The manual specifies that pharmaceutical inspections are generally conducted without prior notice. The agency explains that advance notification often enables inspected establishments to unduly delay inspections—for instance, requesting unreasonably delayed start dates without valid justifications. Such conduct may be deemed a deliberate attempt to stall or obstruct official inspections.

Core Inspection Disciplines

Pharmaceutical inspections adopt a risk-based, systems-oriented framework covering six core functional systems with defined audit priorities:

1.Quality System

Focus areas: independence of the quality unit, defined responsibilities of quality personnel, change control procedures, Corrective and Preventive Actions (CAPA), annual product quality reviews (APQR), etc.

2.Facilities & Equipment

Focus areas: design, maintenance and cleaning of critical infrastructure including HVAC systems, pharmaceutical water systems and process gas systems; cross-contamination mitigation controls.

3.Materials Management

Focus areas: supplier qualification and validation, raw material release protocols, unique material coding, controlled warehousing and storage conditions.

4.Production Operations

Focus areas: batch production records, process validation, cleaning validation, deviation handling and Out-of-Specification (OOS) investigation workflows.

5.Packaging & Labeling

Focus areas: label management controls, packaging execution, in-line inspection protocols and anti-counterfeiting measures.

6.Laboratory Controls

Focus areas: analytical method validation, Out-of-Trend (OOT) and OOS root-cause investigations, stability testing programs and retained sample management.

Data Integrity: Special Focus Area

Data integrity is designated a special area of heightened scrutiny, with the following key audit criteria:

Audit Trails: Verification of mandatory audit trail activation, regular audit trail reviews, and corresponding corrective actions triggered by anomalous trail entries.

Raw Data: Mandatory review of original electronic source data instead of aggregated summary reports.

Metadata: Completeness verification of timestamps, user identification credentials and full modification history logs.

Data Backup & Recovery: Audit of backup frequency, periodic recovery validation testing and off-site secure data storage arrangements.

Unauthorized Data Manipulation: Detection of any unapproved deletion or overwriting of source data.

On-Site Verification Practices

Inspectors may demand live on-site demonstrations of audit trail reviews or immediate provision of raw electronic data generated within specified timeframes.

Quality Metrics Evaluation

Inspectors will assess trending quality performance metrics, including product complaint rates, deviation occurrence rates, OOS incident frequency, timely CAPA closure rates and change control turnaround cycles.

Inspection Priorities Across the Product Lifecycle

Pre-Approval Inspections (PAIs)

Focus: process validation packages, analytical method validation, facility readiness, consistency between commercial manufacturing facilities and information submitted in marketing applications, full data integrity verification, and alignment between application data and original source records.

Routine Surveillance Inspections

Foreign manufacturing sites are typically inspected every 2–3 years; inspections may be expedited following consumer complaints, product recalls or safety alerts. Past inspection deficiencies will be prioritized for re-verification.

For-Cause Investigations

Triggered by consumer complaints, adverse drug events, product recalls, whistleblower reports, inconsistent application data or suspected data integrity violations.

Inspection Techniques & Methodologies

The manual outlines standardized audit approaches applicable to all inspection scenarios:
  • Document Review: Comprehensive review of master documents, batch manufacturing records, equipment logbooks, validation dossiers and change control archives.
  • On-Site Observations: Real-time monitoring of SOP compliance during production, personnel hygiene practices, material status labeling, equipment sanitation and environmental monitoring data.
  • Personnel Interviews: Structured interview protocols targeting quality heads, production staff, QC analysts and validation specialists, together with standardized inquiry techniques.

Protocols for Addressing Physical Resistance, Threats or Assaults

The manual establishes formal procedures for inspectors encountering hostile conduct:

When facing physical resistance, verbal threats or imminent risk of assault, inspectors are instructed to disengage immediately to secure personal safety. Local law enforcement or emergency medical services shall be contacted as needed. All incidents must be documented with precise, detailed records, including verbal exchanges, actions taken by involved parties, and records of attempted or completed threats, physical altercations or unauthorized seizure of inspection materials/samples.

Precedent Case of Obstructed FDA Inspection

A severe case of deliberate obstruction and interference with official inspection occurred previously:

The pharmaceutical establishment and relevant personnel imposed aggregate fines totaling USD 638,000 (approximately RMB 4.39 million): the enterprise was penalized RMB 2.7907 million, its legal representative fined RMB 400,000, and five individual staff members faced fines of RMB 200,000 or RMB 400,000 each.

During the regulatory inquiry, the company intentionally concealed employee whereabouts and provided falsified information to mislead investigators. Despite repeated official instructions to remain on-site for cooperation, relevant personnel insisted on leaving under fabricated pretexts, halting the investigation entirely. Staff members physically blocked regulators to facilitate the departure of non-compliant employees, resulting in a regulator sustaining hand injuries from being trapped between equipment. Multiple employees were mobilized to forcibly seize the inspector’s laptop containing inspection records; regulators were restrained, pushed and shoved to obstruct official duties, and the seized laptop was subsequently removed and destroyed.

The inspection team filed an on-site police report, and local law enforcement secured surveillance footage and other evidentiary materials to support enforcement actions.
